Terms of Service

ListReadily, a service operated by a sole proprietor based in Florida, United States ("ListReadily", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy.

ListReadily is an AI tool for real-estate photos: it enhances listing photos, virtually stages empty rooms, and removes furniture. Enhancement corrects lighting, color, and clarity; staging adds or changes furniture and decor. The Service is designed not to alter a property's structure, rooms, fixtures, or views. Output quality depends on your input photos and the AI models we use.

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for all activity under your account and for keeping your sign-in credentials secure. You agree to provide accurate account information and to notify us promptly of any unauthorized use of your account.

Generating a staged or furniture-removed photo costs one credit; photo enhancement is free. New accounts include a limited number of free credits.

Paid plans are billed monthly in advance through our payment processor, Stripe. One-time credit top-up packs are charged once and those credits do not expire. Plan allowances reset each billing period and do not roll over.

A credit is spent only when a render finishes successfully — a failed or interrupted render is not charged. You authorize us, through Stripe, to charge your payment method for the plans or packs you select, including any applicable taxes.

Subscriptions are month-to-month with no long-term contract. You can cancel anytime; your plan stays active through the end of the current billing period, and you will not be charged again after that. We do not provide partial-period or pro-rated refunds for subscriptions.

One-time credit top-up packs are non-refundable once the credits have been added to your account, except where a refund is required by law.

Because credits are digital content made available immediately, if you are a consumer in the EU, UK, or a similar jurisdiction, you acknowledge that by purchasing and using credits you request their immediate supply and lose any statutory right of withdrawal once the credits are used.

Results are generated by third-party AI models and may contain errors, artifacts, or inaccuracies. The Service is provided on an "as is" and "as available" basis. You are responsible for reviewing every result before you use, publish, or rely on it.

We design the Service to keep a home's structure, rooms, fixtures, and views faithful and to change only furniture and styling, but we do not warrant that any given output is accurate, complete, error-free, or fit for a particular purpose.

Many MLSs and jurisdictions require that virtually staged or digitally edited photos be disclosed (for example, California's AB 723 and similar rules in other states). To help, we provide a labeled "Virtually Staged" version, a side-by-side original, and a disclosure note with every download.

However, you are solely responsible for complying with all MLS rules, board policies, and laws that apply to your listings — including using the labeled version and making any required disclosures. You agree not to present edited photos in a way that misrepresents a property.

You agree not to: (a) upload photos you do not have the rights to use; (b) use the Service to create misleading or deceptive imagery or to misrepresent a property; (c) violate any law, MLS rule, or third-party right; (d) disrupt, reverse-engineer, scrape, or attempt unauthorized access to the Service; (e) resell or redistribute the Service without our permission; or (f) use the Service to generate unlawful, infringing, or harmful content.

You keep all ownership of the photos you upload and the results you generate ("Your Content"). You grant us a limited, worldwide license to host, process, transmit, and display Your Content solely to operate and provide the Service to you — including sending it to the AI providers that render it.

You represent and warrant that you have all rights necessary to upload Your Content and to grant this license.

The Service, including its software, design, and branding, is owned by us and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks, or to copy or create derivative works of the Service.

The Service relies on third-party providers (including Stripe, Supabase, OpenAI, Replicate, Vercel, and Resend) to function. Your use of the Service may be subject to their terms, and we are not responsible for third-party services. See our Privacy Policy for how these providers process data.

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months before the event giving rise to the claim, or USD 100.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including MLS or disclosure rules.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to us or others. Provisions that by their nature should survive termination — such as content licenses you have granted, disclaimers, limitation of liability, and indemnification — will survive.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in the State of Florida, United States will have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to venue there.
